All the 5 level restriction does it make it so those that have high level characters can barely pk at all

Here is the point of yours that is invalid by your statement. If most of your kills comes from levels 31+ that means that even with the 5 level restriction you will still be able to pk regularly and it will not make it to where "high level characters can barely pk at all".

Yes i pk alot of upper levels that does not mean if I want to pk someone lower that I should not be able to. If you played in the beginning 30's killed lvl 1's.

Yes they did, but since then nightmist has changed drastically. And the population is not as good as it once was. I've seen many players come and go because they just got camp pkd over and over again. I do agree that pking is what makes 1a strive and by no means want it taken away but you cannot disagree that a level 35 pking a level 25 is insane. To be honest, I would rather just see a 25-30 area like walt proposed then making it a 5level cap for levels 31+ but that would take more time from the staff which right now doesn't look like its going to happen.
